Thanks Rob, the beauty of the Eastern Cape Gambling & Betting Act is that it is quite
different to other Provinces, and ensures complete transparency and public participation
in any application phase.

What has to happen now is that my submission has to be sent to whoever is behind the
application by Shakori (Pty) Ltd, and they have 30 days in which to respond.

Within 60 days (that would be around 16 February 2012), there would have to public
hearings. As part of my submission I have requested that I be allowed to make oral
presentations, so that ensures I have to be informed of them, regardless of where the
advertisement for the hearings is placed (in case it is in the Daily Sun again).

I will update as I hear anything..

The reply to my submission to the ECGBB by Shakori (Pty) Ltd
is attached. These are all documents which should be on public
display at various venues.

Some extracts of the Eastern Cape gambling laws are included below:

Section 25 of the Act has to be read with Regulation 8

8. Inspection of application documents.—(1) Subject to the provisions of
section 25 (2) of the Act—
(a) application documentation shall lie open for public inspection at the offices
of the board from the date contemplated in section 25 (1) of the Act until
14 days after the expiry of the three month period contemplated in that
section; and
(b ) a copy of the application documents shall lie open for public inspection
during normal office hours at a place approved by the board within the
same magisterial district as the premises to which the application relates
for a period of one month after the date of publication of the notice
contemplated in section 21 (1) of the Act.
(2) The Applicant shall be responsible for providing a place for inspection as
contemplated in subregulation (1) (b).

Section 40 of the Act also requires that anyone acquiring more than 5% or a
controlling interest must apply for Board approval (form LA 11).

40. Financial and controlling interests.—(1) Any person who, directly or
indirectly procures a controlling interest or a financial interest of five per cent or more,
or any lesser percentage as may be prescribed, in the business to which a licence or
a registration in terms of section 61 relates shall, within the prescribed period and in
the manner prescribed or determined by the board, apply for the consent of the board
for the holding of such interest.

Public hearings should now be held before 16 February 2012

So Moses Madondo who wrote this response is the CEO
of Betting World, as just seen on TV after the Cape Flying
Championship.

In case anyone missed the notice in the PE Herald of Friday 23 March,
the public hearings for the application of the amendment of their bookmaker
licence by Shakori (Pty) Ltd (who traded as Betting World in PE) is scheduled
for 10 AM tomorrow (Monday 26 March).

Unfortunately the Eastern Cape Gambling & Betting Board have elected to
hold the hearings at their offices in East London, and not in Port Elizabeth.

A copy of the notice is attached if anyone is interested.
