Bob, I think you'll find he's British rather than English 
As far as I am aware it is not cut and dried but Fourie is reluctant to go through all the red tape to get there, which would be his choice. I am not saying its right by any means, I just think the whole visa/immigration thing is completely farked up, pretty much everywhere.

True that Englander.One has to go through the process of getting a visa or permanent residency.And you what sometimes its not as bad people try to make it.Just concluded mine here in Australia almost one year to my arrival I have been granted permanent residency status.

Former England international Hendre Fourie told he can stay in Britain after visa reprieve
Former England international Hendre Fourie has been told by immigration officials that he does not have to leave Britain, despite fearing he was on the brink of deportation having retired with a shoulder injury.
Officials from the UK Border Agency contacted Fourie on Tuesday after he revealed he was moving back to South Africa because he thought his working visa had been terminated on his enforced retirement.
Fourie believed he had only 60 days from the moment his club, Sale, informed the Border Agency in December that his employment had been terminated.
But the agency told him yesterday that the process had not been started. It also discussed options that would enable him to remain in the UK.
“We have not curtailed Mr Fourie’s visa at this time and he is not required to leave the UK,” a UK Border Agency spokesman said.
“His employment contract with Sale Rugby Club has been terminated and his employer has rightly informed UKBA of this decision. We are considering what action to take next.
“If an individual’s circumstances change and they no longer meet the terms of their specific visa they can apply for a visa of a different type.
“Mr Fourie has been informed of the process and the various options available to him. It is entirely up to him if he chooses to explore any of them further.”
Fourie, who has lived in the UK for eight years, played for England eight times before retiring after two operations failed to cure a long-standing shoulder injury. He was living in Britain on a “sports people visa” that was due to expire in June.
Fourie was born in Burgersdorp in South Africa but qualified for England on residency grounds, having joined Rotherham in 2005.
The former Leeds Carnegie player said this week that he had hoped to remain in Britain to pursue a teaching career.
“I wanted to repay this country,” he said. “I wanted to give something back. My wife is South African, but my boy was born here.
“There were options to appeal but I would have had to wait another few years before I could get my permanent residency. It has been a red-tape nightmare and we just decided it was not worth all the hassle.”
His case sparked fears that other professional athletes born overseas but living in the UK on working visas could be thrown out of the country if injury curtailed their career.
The Rugby Players’ Association is advising Fourie. It believes his is an isolated case. “Hendre’s case is particularly complicated and we do not believe that other high-profile players will be affected by this ruling,” an RPA spokesman said.

Hendre should have done what a few others have done before him, that is....put the name Abu in front of his own name ( as in Qattada or Hamza ) and claim political asylum. A short while later he would have had the UK taxpayer paying for his legal bills and his everyday upkeep
