Savasp, chill bud, it is now legal to defend yourself physically against words..... if it is ruled that the said words can cause physical harm you can strike out at the speaker of those dangerous words.

Regarding the case of Paul Peter, if I was him i would take it to court, the NHRA would have no chance.
1. The inspection was not carried out by the SAPS drug unit or an official member of the MCC investigative unit.
2. The manner in which the said syringes were transported for testing must be laid out.
3. What SOP's were followed for the transport and testing of Schedule 5 drugs?
4. Do they have the temperature logs both from the transport vehicle and testing lab?
5. The rules of the NHRA do not superseded the laws and protocols that already exist.
I do not agree with Mr Peter and believe that the law should take its course but I am tired of the way in which these cases get handled.

Have the NHA finally graded prohibited substances?
Why are those 2 charges worth R200,000 per charge?-I would think an appeal against the fine must succeed, if compared to other fines which we have seen for substance abuse.
I understand that testosterone is different to medication but do the rules recognize that?

Bob, that could place the local presenters at risk..... a NHRA finding has not been tested by our courts and the charge and sanction is not by the SAPS or MCC, two bodies that could actually criminally charge for illegal use or possession of Schedule 5 drugs.
Personally, if any trainers horse tests positive for testosterone when in training which cannot be verified by a Vet then surely the sanction is permanent warning off. It is exactly what I do not understand about the NHRA, surely they are not authorised to fine anyone for the use of illegal drugs before the SAPS and also not report this to the SAPS....
I will also enquire with the DOH how anyone could impose a fine without reporting the incident to them or the SAPS. Would be interesting to understand if the NHRA have special dispensation to do so.

I also don't understand why blatant performance enhancing drugs (as opposed to anti-inflammatory) no longer warrant a warning off .............used to be for life didn't it?
Insofar as the SAPS ,you certainly raise food for thought ,but my immediate reaction (but only a guess) is ....are the SAPS interested in drugs ,given to animals? .........and in fact ...Is it a crime?

As a National Trainers forum, together with Vets, Robert Bloomburg (from a technical/legalese aspect) and NHA worked on these classifications to bring us up to International standards.
The goal was classification. In the past, before this, for example, a harmless but detectable ulcer paste would carry the same sentence as a performance enhancing drug.
So, the NHA are very much on par with International standards and the current classifications are clear.

The question that now needs to be answered by the Jockey Club is what does a trainer need to do to be warned off? Multiple doping positives result in a fine, when exactly are the NHA going to start restoring the integrity they proclaim they champion? As an outsider it appears that if you have the legal muscle to defend yourself then you can get off any charge. What would be the outcome be if a smaller less financially secure yard went into a hearing without Manny Witz?
