Hibs I see Hughes and Fox got suspensions with the new ''Whip ruling'' enforced yesterday.... Were jockeys holding back yesterday??

The punter can get done in with this new rule, what happens if 2 horses are going head-to-head to the finish and a jockey has used up all his smacks with the whip... Does he take the chance and use the whip thus getting a suspension or just ride with his hands and possibly loose the race?? ... Stupid rule imo.
