The rule allowing a race to be declared NULL AND VOID is ALWAYS an option, and would have been the only way to rectify the starters error IF THE HORSE HAD RUN 2nd or 3rd !

Rob you are correct racing needs the punters... but the rules simply cannot be in the punters interest alone....impartiality has to be maintained for the integrity of the sport.....although the stipes imo did not deal with the incident a lot more expediently may indicate that they were not quiet sure how to rule......the aggrieved Eudey correctly stated that the final decision was a no brainer....yet it had to be pondered under the circumstances

many years ago a very similar incident happened to Tiza (when he was 2yo) - his gate did not open at the same time as the others causing him to lose at least six lengths. He ran third and was subsequently deemed to be a runner therefore saving pa's but costing the people who backed him to win. The stipes called it a rub of the green ruling, So unless the rules have changed since then I would say you are wrong Titch.

Craigs horse took up space and helped make the result ,the only possible outcome should be a void race

@ Nagboy
If you are refering to the time Tiza ran 3rd behind a horse of Buddy Marouns (cant recall the name) but do recall the race coz I backed Tiza
the "official" report stated that the gate did in fact open on terms and that the horse was slow into stride hence the rub of the green verdict...a point that many, including myself contested but to no avail...

Sean Phillips, who backed his horse and had it in the PA would beg to differ, why should his horse be punished and the other owners whose horses earned stake cheques... as well as those who managed to get thru the 1st leg of the PA...which by the way does not include me I went for Craigs horse in all my bets..

Titch, can you read at all mate.............it is exactly the opposite of your reading FFS.
If the horse had placed the only fair outcome to both sets of punters is "NULL AND VOID"
It's worth remembering that fault was in the equipment and/or starter...........why should either punter be prejudiced.
.........and there is provision within the rules ...........they do not need bending!

Titch I can assure you the stipes knew Tiza's gate did not open. He in fact head butted the gate trying to jump with the other horses. The issue was it was a feature race so if declared a scratching he would lose the stake and minor black type. The winner was Carnadore trained by Charles Laird at the time I think. Perhaps the only fair way to deal with these instances is to declare the race null and void for betting purposes but stakes earned etc are still won.

Nagboy we must be talking about different races?? It was a Feature race but Buddy definitely won the race im referring to, I can remember reminding myself never to take him on again in sprints, this was in a conversation I had with myself all the way home in my car...
