There is a big difference - If I walk into a licensed bar(or Betting Shop) - as far as i know the Licence must be displayed prominently - then how could I possibly be regarded as being party to the "crime" or the owner of the bar sells me cigarettes that he has not paid duty on- There is no way any court would prosecute a customer who happened to watch a pirated "stream" without his knowledge - How will the customer even know the bookmaker is on the Teletrack payment plan? Also what would happen if a private person walked into a room and started streaming teletrack on his Laptop using a legitimate stream BUT the bookmaker does not show Racing himself on any of his TV's? Could that bookmaker be prosecuted? I doubt it as that stream is for that person's personal use.

They are not BETTING illegally but broadcasting a product illegally which has nothing to do with the customer - Simple example that will tel lthe Phumeletrack people that they have NO chance to prosecute customers of Rogue Bookies - If a Metro Policeman pulls over a Taxi and the driver has no license the Policemen does not arrest the passengers so that idea will not drive punters to their outlets

I guess you right, but if it became known to me that the taxi driver had an illegal drivers license and I still got into the taxi?

Well let's see if the police will try and arrest punters for "watching" - I don't see it and doubt if any prosecutor even the esteemed Nel would even look at such a case - The punter is not doing anything illegal as he is not "broadcasting" the product and his betting is completely legal - I wonder how Phum would feel if a bunch of punters got together and brought a class action against them and Teletrack on the grounds that they are forcing a monopoly on them as they cannot enjoy watching races unless it's at a Phumelela approved venue where WE pay for the right to watch?
Punters fund racing despite what breeders and owners think (obviously punters can be breeders and owners too)- It is our money that puts up the stakes yet we are the people being screwed (especially the home punter that pays for a channel and now gets less than before just because of a fight between bookmakers and Phumelela/ GC)

Tellytrack: Urgent application struck from roll with costs
Honourable Judge Vally of the Gauteng Local Division, Johannesburg, heard argument from the applicants (Keith Ho t/a Betxchange and Play Bet Proprietary Limited), the legal representatives appearing on behalf of the first respondent (the Minister of Police) and the ninth, tenth and eleventh respondents (DM Kisch, Gerald Bourne and Farrel Frank), and Tellytrack, respectively, on the issue of whether the matter should be heard on an urgent basis.
Judge Vally ordered that:

1. Tellytrack’s application for leave to intervene in the matter be granted and awarded party party costs against the applicants, including the costs of one counsel; and

2. The application be struck from the roll due to lack of urgency and awarded party party costs in favour of the first, ninth, tenth and eleventh respondents and Tellytrack, including the costs of one counsel.
