In a communication dated 15 August 2014, Mr Bheki Nkosi, Acting Chief Executive Officer of The Gauteng Gambling Board confirmed that the Board have taken a resolution to hear Phumelela’s September 2011 Application for an Amendment of its Totalizator Licence Conditions on a de novo basis. There are 3 license conditions that are being appealed and they are listed below.
Clause No 11 of Schedule B of the Applicant’s Totalizator Licence which reads: “The licensee shall maintain a telebet center in the Province. The advertising of telebet facilities in the Province shall contain a local telephone number. The bets so received shall be struck in Gauteng and may not be transmitted to centers outside the Province.
Clause No 14 of Schedule B of the Applicant’s Totalizator Licence which reads: “The license shall remain valid for as long as Phumelela Leisure and Gaming Ltd or any of its subsidiaries continues to hold a race-meeting license in Gauteng.”
Clause No 10 of Schedule B to the Applicant’s Race-Meeting Licence which reads: “The license shall make available visual broadcasts of race meetings for betting purposes. The licensee shall be entitled to recover reasonable costs for visually broadcasting such race meeting information, provided that such costs are approved by the Board.”
Phumelela have applied to have all three conditions removed.
The Gambling Board will also adjudicate the dispute lodged by Gauteng Off Course Bookmakers Association (“GOBA”) against Phumelela.
