I think what was proved is not much more than culpable homicide (or that other fancy latin term meaning murder ,regardless of victim)

I think that a very large part of the public will ever "acquit" him though..................his life will always be tainted ???

I am rather shocked with the update I just heard but I am no legal expert but would think the result won't go down well with majority.

My limited knowledge tells me that judgment seems flawed...in his own words, he had no intention to shoot at door or person/s behind the door...so that should have ruled out putative self-defence but yet she has made a judgment that his actions were in self-defence...intent doesn't relate to who was shot but that intention was to shoot someone...

I'm confused...

From news24..."What a lot of people are struggling with is how shooting 4 times into tiny space could not constitute intention to kill in judge's view."

Judge and assessors have muddied the waters on how the law should be interpreted... :(

Judge and assessors seems to be mixing dolus eventualis (perpetrator objectively foresees the possibility of his act causing death and persists regardless of the consequences) and culpable homicide requirements...

I'm even more confused...

Guess that's why I'm not in the legal profession...

The one thing is clear ,and that is why the wheels of justice turn slowly...........more than 30 mins seems to exhaust the courts...........................lol

As part of a Forensics (Accounting / Auditing) course I did last year, I had to read a book called Criminal Law...just when I though I had some understanding of some aspects of Law, along comes this judgment and muddies the waters... :(...Eish...
