Sure this old news but what the hell.

the National Horseracing Authority confirms that an Inquiry was held at its offices in Johannesburg on Friday, 27 July 2007 which was adjourned and resumed on Friday, 23 May 2008 and again adjourned and resumed again on Friday, 29 August 2008 and finalised on Friday, 5 September 2008. Mr S G Tarry was charged with a contravention of Rule 73.1.1 He was charged in the alternative with a contravention of Rule 73.2.4.

Trainer Tarry pleaded not guilty to both charges.

The Board accepted Mr Tarry’s evidence unequivocally that he was not party to the administration of a prohibited substance to the horse MAILON (ARG) prior to it taking part in the 10th Race run at Newmarket Racecourse on 10 March 2007.

The Board was satisfied that on the facts established in evidence led by the NHA, Mr Tarry was guilty of a contravention of the provisions of Rule 73.2.4 and accordingly Mr Tarry was found guilty of a contravention of that Rule in that he was the Trainer of the horse MAILON (ARG) which ran in the 10th race at Newmarket Racecourse on 10 March 2007 at a time when a specimen taken from the horse MAILON (ARG) contained a prohibited substance, Flumethasone.

In consequence of this, the horse MAILON (ARG) was disqualified from the said race in terms of the provisions of Rule 72.3.2.

The Board also imposed a penalty of a fine of R60.000.

The horse Mailon tests postive on 10th March 2007.Is disqualified on 5th Sept 2008
The rule is quite clear "if the horse tests positive the trainer is responsible"
Why does the NHA take so long to finalise these hearings.A disqualification of a horse in a major race could alter the Trainers Championship.
Also the 2nd horse gets the stake and may well have dropped or gone up in the merit ratings by 10 points over 18 months.
It would also seem that the BIG TRAINERS are able to drag the hearings out.In Cape Town a small trainer G.Collins pleaded guilty and was fined in the space of a few weeks.
