Pound Bloodstock buys Lets play poker- BSA online sale???

I have a question driven by curiosity.
The above horse was sold on the auction by Drakenstein to Pound Bloodstock. 6 November 2024 160k fnal bid.
It was carded to run 7 November 2024 for Azzie/Drakenstein. Race 1.
The horse ran with no mention in stipes report after the race or on Gallop before the race, with regards change of Ownership.
The horse ran according to Gallop in Drakenstein colours.
Below is point 8.2 from BSA conditions of sale.
Stipes report mentions the horseJockey G Lerena reported that he felt something amiss with LETS PLAY POKER in running.The Veterinary Surgeon was requested to examine this gelding.:VETERINARY SURGEON REPORTED:a) LETS PLAY POKER not striding out right front.
Generally in the past u see notes like. Sold with engagement. Horse runs in new colours. Or scratched. sold without engagment.
What happened here? What rule would NHRA have used to allow the horse to run??

RISK, OWNERSHIP AND MAINTENANCE COSTS
8.2
All risk in respect of a Horse sold at the Sale shall pass to the Buyer “on the fall of the hammer”,
at which time the Buyer shall forthwith be responsible for the
care, keep, custody, control, insurance and security of and for the Horse and for all expenses relating thereto and shall bear the risk of injury to, sickness or death of the Horse.
The Buyer agrees to release, defend, indemnify and hold the Association, its officers, employees, agents and representatives and the owners or operators of facilities in use by the Association (collectively “the Indemnified Parties”) harmless from all losses, damages, liabilities, expenses, claims, causes of action or legal fees arising out of or related to the possession, care, keep, custody, control or maintenance of any Horse on which he is the successful bidder, including any claims arising out of injuries, sickness, death or damage caused by the Horse after the fall of the hammer, save and except where the Indemnified Parties or any of them may be held liable in terms of section 61 of the Consumer Protection Act.
