Goodman to pay R40 000 fine - plus R10 000
NHA PRESS RELEASE:
Appeal – Trainer Mr J M Goodman
The National Horseracing Authority confirms that an appeal lodged by Trainer James Goodman was heard in Johannesburg on 11 December 2008.
Background
At an Inquiry which was concluded on 12 September 2008, Mr J M Goodman was charged with a contravention of Rule 73.2.4 in that he was the trainer responsible for the horse EPIGRAF at the time when a specimen taken from this horse after it participated in Race 4 at Greyville Racecourse on 24 January 2007, disclosed upon analysis the presence of Salbutamol (Albuterol) which is a prohibited substance in terms of the Rules of The National Horseracing Authority.
Mr Goodman pleaded not guilty to the charge. The Inquiry Board found Mr Goodman guilty of the charge and imposed a fine of R40 000,00. Furthermore, in terms of Rule 72.3.2 EPIGRAF was disqualified from the race and the provisions of Rule 67.7.8 apply. Mr Goodman exercised his right to Appeal.
The Appeal Board was of the view that there was no basis upon which to set aside the conviction or to interfere with the penalty imposed. The Appeal Board therefore confirmed both the conviction and the penalty.
The Appeal Board also ordered the prescribed fee paid by Mr Goodman forfeited and that an amount of R10 000,00 was to be paid by Mr Goodman as a contribution towards the costs incurred by The National Horseracing Authority of Southern Africa.
