Identify theft - well almost!

I have a lightie who has been pestering me for a set of wheels. he is at varsity so i take pity on him and say put 10k, i put 40k and we buy a fairly decent 2nd hand car. the lightie save and save and he come with his 10k ( after mom throws in a helping hand! )
my trouble begins when he finds the car he want from a dealer. i check the car out and it looks ok so i agree to buy. times are hard so i match his 10k for a 20k deposit and the total outstanding is 33k that i ask to finance over 24 months. No problem the sales guy says good deposit so should be no problem. BIG problem as after the cherrie take my application she phone to tell me YOU HAVE A JUDGEMENT SO NO FINANCE!
this does not make sense as I am very tight with my money and credit rating, in particular in these tuff times. I go to the dealership because I now there is fault and I am given an ITC that say I owe a service centre in Cape Town 907 rand from Sept 06 with judgement taken in August 2008. The problem is that it is my ID number on the form but the details and adress of a chick in Cape Town. The cherrie from the dealership then says ja there is definitely a problem because your id is for a mail and the "guilty party" is a femail.
She then phone ITC and they say we only work off court papers I must now fill in a despute form that can take a month to sort out. now i am the bliksem in and on the form it stands the service centre contact details as well as the law firm that took judgement. I phone the lawyer and he tune me there is definitely a problem and will come back to me. I then phone the service centre and the lady tunes me, no ways, she now the "guilty party" and that she has supplied NO id details to the lawyer.
So now I sit with a bad credit record, a lightie without wheels and I must run around to sort out this shit. My question is I could be seriously affected by this judgement - no one hire someone with judgements. You have got to ask where does the lawyer get my ID and supply it to the court?
Any legal minds out there - do I have any steps to take to give this lawyer a lesson? If I get anything I donate it to a charity. I just think that these type of mistakes can ruin peoples reputations and lives.
I now this is not racing but can we leave for a day before moving to other affairs please hibernia and scotia.

I can understand your frustration Mike, wish you luck in resolving.
My wife had her bag stolen last year in Cape Town and it has been a nightmare.

Hi MM!
I would suggest:
get an affidavit, stating correctly that you know nothing about this debt and judgement. Draw attention to the fact that a 'femail' is cited!
Send this to the attorney, ITC, Clerk of the Court (Cape Town I presume), Law Society (Cape Province) and the Ombudsman's Office, National Credit. You can have the judgement rescinded & your good name back.
The reason I mention Law Society, it is to ask them to investigate how this attorney got your ID and why he will not correct the lousy situation.
Also, from what I know, there is such a thing as 'prescription' of a debt- this means, if you have not been contacted directly by the firm who you supposed to owe money, for more than 2 yrs, it is written off: they cannot claim against you!

be the nice guy..
get all the paper work ready..
see an attorney...
let your attorney deal with the other attorney..
get the judgement removed....
law society...a toothless organization...don't bother..better you join the church choir..
step 2..
track the attorney..
pay the tow truckers to hook his car..drop it in another town..
keep on doing this...
step 3..
pay the tow truckers to load him into a sprinter enroute to windhoek..
they will break both legs..
drop him with no phone..no money ... 100km from the closest town in namibia..
no other sprinter will pick him up..
step 4..
when you see an attorney in a pub..remind him..a candidate for namibia..
remember...it's now a lawless country...watch tv and see it..
and I practise what I preach..have !@#$%^&*()@#$%^ more than 6 in the last 5 years..
hate them with a passion..
how do you know a guy at the pub is an attorney....he tells everyone..

thanks for advice guys, have filled in dispute form and must maar wait to be cleared.
the lawyer who did list me has not even phoned me back. i am serious in considering taking legal action against him

HI MIKE,
MY Lawyer whom i sell the insolvent estates for work with this every day. She should sort this for you quickly as she stops judgements for people before they sequestrate etc.

PS - this might be useful. You can get a free credit report annually from Trans Union (
www.transunion.co.za
) - it is worth checking to see who else has been making queries on you.
Me being paranoid - I've subscribed to the report and monitoring for R180 a year - so if there is a change on my report I get an SMS to let me know.
I've also just seen too much identity theft floating around.

Why worry..
you are married to some Nigerian on the home affairs system...
your company has been hijacked at sars...
the directors have been changed at the registar of companies in pta..
the new directors have used your company to open a bank account at stdbank..done a vat claim...vat number at sars still points to you..
multiple cases...
a royal @#$%^&*()__)(*&^% on the Government IT systems..

you have a 1000 points..need 700 to qualify for credit...
late payments the IT systems subtracts 100 points...
best you buy a new ID number for R400..buy a few...a degree too while you are at it...apply for RDP house too..

just had a call from lawyer and leaving the 5th message
