Retrenchment

If anyone can give me advise on the following subject I would appreciate it

If a person is retrenched and the package agreed on ( 10 years service ) and the company does an about turn and refuses to pay out the package given that the package is in line with minimum requirements what can should be done to obtain the agreed on package?

1. CCMA ruling
2. Labor court ruling
3. jail for executives if they dont pay up

they use an external girl - labor broker/ccma/specialist

get her opinion.
she did some work for me too, a few years back.

one week/year is required, minimum.

If that has been paid hard to win the case, if not should be no problem at the CCMA

payment is being delayed however the firm belief is that the company is going to close down

under thew new corporate governance laws
the ceo, cfo etc will be jailed if employee payments not done
they can close the company...but have to pay the employees as per the labor court ruling
dont have to pay the creditors..will be liquidated and creditors will/might recieve monies.

the main aim is to get your money..
grab what you can get NOW.
go in and see them.
let them give you 2 or 3 cheques to make up the full amount.
cash what you can NOW.
it's obvious...cash in the bank is the problem..that's why the payments are delayed..?

harsh reality...
many companies will go the same route during the next 3 months.
unions expect as many as 1,000,000 retrenchments before 31/12/2009
that's in the next 3 months.


dont wait for the EFT at the end of the month.
creditors demand payment during the month and cheques are made out to them.
by the time the payroll run is done, the EFT cannot be processed, as there is not sufficient funds left in the bank account...due to cheques made out to creditors during the month..

ask for a cheque.
even ask for an advance, but get money NOW.
you might not get money at the end of the month.
it might take months before the curator pays you.

Very sad state of affairs at the moment. Big Companies as well as small ones taking strain.

Great site this Mr Scotia. Now i can get HR related advice from West When i dont feel like fighting with the boss.

I was going to suggest salt and ENO in the directors sugar bowl.

Bring a birthday cake..pretend it's your birthday

they will bake you a 75cm by 75cm birthday cake..
special requests is their speciallity...

ask for some laxatives to be included...x 5...

the PA's will always make sure that the boss get's a bigger slice..
have it with morning tea..
no one can resist the temptation...
by lunch time the fun starts..

I sat in many boardrooms..
by 2004 some guys became very snotty..I could not understand Xhosa or Zulu...
we fix the balance with birthday cakes...
they now speak afrikaans to me...with a smile...
