Yes Dave but the CCMA is an arbitration body....if I have not been happy in the past I have gone to court, they are not the final say.

The whole situation is a very bad reflection on the industry as a whole, especially with the NHA making another decision that i think is high handed and not with much legal merit.

Yes yes yes Tiger but the time consuming process is just frustrating and non productive and also a financial pain .

I was being flippant, but considering what the trainer would have to had to endure.

If he had given the groom the bullet, he would still be back and forward to hearings which i am sure the time alone would have taken a toll on his training position.

There is one trainer in horse racing that I know that can make a difference. He is Louis Goosen. I remember that he and other Vaal trainers pulled a coup in the NHRA to oust Advocate Joubert and to replace him with Andy O'connor. I do not know the reason for the coup yet I can tell you that it was successful and handled with military precision. If Louis Goosen says its time to throw in the towel, horse racing has no future. I hope that Louis and the Vaal trainers get together and do something that will make a difference and show there has to be change. They have the power in their hands.

For 10 years the punters on ABC have been telling the industry they've had enough.

A new owners association has been formed because they have had enough.

The heading here says trainers have had enough.

The only ones yet to have had enough are the incompetents sitting on the gravy train!

I had a truck stolen many years ago out of a locked yard.
This happened on a Saturday night and was only discovered on Monday morning
The vehicle was in and accident on the Sunday and knocked a cyclist of his cycle
This person spent about 14 days in ICU and was never quite right .
The thief was an employee of the company but had hotwired the truck
Got 3 years imprisonment but argued that he had received permission from our
storeman
Never any talk of charging anybody in the company
Not quite the same but similar

Why do we always make such a fuss over small things-Was the horse hurt badly?Can a groom actually hurt a big animal like that with a kick -maybe Smanga Lee- I understand these are expensive animals and they are most precious to all of us but kick another person you dont even get 40k fine.Give the groom a stern warning -he works with these animals and they can be very naughty -if he does it again ban him from racing -how in the world can you fine the trainer.We forget that we are all human and things happen in the heat of the moment.Look at the incident and think of not always condemning someone -try something constuctive and let them learn through the incident.

This issue all revolves around a principle "in the scope of his employment"
In Elmers case, the employee was clearly not,so no claim on the company
Grooming the horses , he is certainly acting within the scope of his employment so any liability for damage could extend to the employer ........:however this is tantamount to a "criminal act"so to fine the employer is probably inappropriate!
