But I would think GC and Phumelela would have to issue that ... It makes no sense banning him only on racedays only as it is then presumed he only commits acts of violence and intimidation when racing occurs, or is only capable of breaching covid regulations then.... had he not resorted to violence and verbal abuse he might have had grounds to dispute the covid regulations as he and his wife were not in breach of government regulations being outside and away from any people.But if he is not sanctioned harshly things could escalate as his behavior does not suite any society let alone one based on competition and betting.

Going back to the scene of the crime is this the chain of events that occurred?
Mr. and Mrs AF are seated outside in the grandstand .One of them has the face mask down because they are talking.
The Security approaches them and instructs him to put on the mask or he'll be thrown out.
That's when the shot hit the fan.....lol

Assuming the guilty party are fans of SANTA........
Where was SANTA when he was needed?
He was on course for sure as it was Xmas in July and he had a runner in the big one.
Why did SANTA not intervene and diffuse the misunderstanding?

He has brought racing into disrepute. That is a rule somewhere.

3 years 11 months agoNo doubt but the question is why only on racedays and not when he works as an assistant at the training tracks...I would think that the NHRA does not want to stop him from earning a living until the hearing is settled...Also take the scenario of a Music Festival held in a park...A person acts violently while attending the festival and the organizers and court ban him from attending that festival in future but as the park is a public place they don't ban him from using the park for exercise...I think once the hearing takes place , probably after criminal proceedings are completed, then the NHRA might take the steps of suspending his rights as an owner and assistant trainer for a period of time...I really can't see a fine or a suspended sentence as he has brought racing into the news through alleged criminal behavior.....Who knows though as his record shows second,third,fourth and more chances...Maybe his course now should be to start anger management classes in mitigation of sentenceMac wrote: He has brought racing into disrepute. I got to know Andrew when he was the regular rider on our champion filly Princess Victoria. Probably the most naturally gifted jockey in SA since Michael Roberts. He was unbeaten on her in her 2yo career, including the Gr1 Allan Robertson and then Gr1 Golden Slipper. His ride from a wide draw in the Slipper was sublime. Unfortunately he was off with an injury for her 3yo career. He rode her once more in her swan song race the Champagne stakes, winning easily, before she went off to stud.
His life story, with its ups and downs is well documented, but his achievement in coming back from it all to win the jockey championship while only riding at the top of the weight scale was amazing.
He is one of the funniest guys around, and one of the characters of the game.
He and Ashley have done very well in a short time to build up their yard in a time when the industry has been shrinking. I’ve had horses with them and Ashley is a very good trainer.
I don’t condone his actions at Greyville, and he will have to take the consequences.
However, once this is over, and he has served whatever sanction is handed down, I would welcome his return to the game.

91.1.2 has been suspended by any SPECIFIED RACING AUTHORITY, shall be prohibited from
participating in horse racing in SOUTHERN AFRICA to the extent determined by the racing
authority imposing the suspension and for such period as may be prescribed in the
suspension order
Here is the rule so they have leeway as to the extent of suspension clearly - If a trainer behaves badly only at the loading pens but is otherwise peaceful then theoretically I think the NHRA could suspend him from pens but allow him to perform other duties

I think it is the capitalists behind this and that he is totally innocent, always has been..... got to love the Stockholm Syndrome on here.
The DBN View Room was made available for trainers as the Racing Operators want to ensure that racing continues and one of the conditions was not to show anyone in the stands on live TV which would court more controversy. I suppose we could find yet another reason why no rules or laws apply to Mr Fortune.
I wonder what would be the opinion if this happened prior to the JULY and racing was cancelled because of it?

There have been incidents on July Day on course and it would be interesting to note how many were arrested by the SAP.
Like the one year when a local rapper, also from the Flats, I think, was performing on stage in the centre of the course.
An over-zealous fan, after having one too many, ran onto the stage and started dancing to the music.
The rapper took offence and literally booted the fan off the stage by kicking him in the butt and accusing him of spoiling his act.
That was assault in any language and charges should have been laid against the rapper via the SAP.
Incidentally it was this rappers fiancee that died tragically recently.
Then the cases of theft on course from punters by pickpockets and some punters taking action against the thieves.
The Security instead assaulted these punters, why not bring the SAP in to apprehend the pickpockets?
There needs to be serious communication between the Security and Racing Managers on course to prevent these ugly incidents from escalating even when there are no crowds on the track.
