Maybe - if you can prove he was deliberately cheating and it wasn't a case of legal medication that hadn't completely left the horse's system. Good luck with that - in this day and age it is not as easy as it was to rob a person of their livelihood, and the NHA's (when it was still the Jockey Club) record in court is already bad enough. In a dream world I'd have to agree with Mentor, but you'd have to be very naive to believe that horses compete on food and water alone. The same goes for any athlete of any species.

They were tested and found to be contaminated with traces of hallucinatory substances!

Inquiry – Trainer Paul Peter
The National Horseracing Authority confirms that at an Inquiry held in Durban on 3 October 2011, Trainer Paul Peter was charged with a contravention of Rule 73.2.4 in that he was the Trainer and the person responsible for the horse STARSPANGLEDBANNER, who ran in and won the 2nd race at Clairwood Racecourse on 26 June 2011, after which a urine specimen taken from this horse disclosed upon analysis the presence of Methandriol which is a prohibited substance in terms of the Rules of The National Horseracing Authority.
Trainer Peter pleaded not guilty but was found guilty of the charge. The Inquiry Board imposed a fine of R45 000,00.
Trainer Peter has the right of appeal.
Furthermore, in terms of Rule 72.3.2 STARSPANGLEDBANNER is disqualified from this race and the stake monies are to be returned for re-distribution in terms of Rule 67.7.8.
The substance is a pure steriod and not used for anything but muscle building and toning, the only medical reason for treating horses with methandriol is to speed up muscle growth after a muscle tear and speed up the repair. I'm sure if this horse had a muscle tear problem a more dedicated passionate horseman would have rather rested the horse instead of the quick fix.

@ J-Pegged
I'm sure if this horse had a muscle tear problem a more dedicated passionate horseman would have rather rested the horse instead of the quick fix.
That is exactly what my trainer had done with La Pucelle. She was on a farm since January and only came back into the yard in August.
A very seasoned vet ( a vet to David Payne in SA) told us that "there is no quick fix for muscle problems. If you want to see your filly back on the racecourse and winning again, a 6 month rest is a must and just leave her alone ".

THank fudge he did not use Voltarin...... that's what real cheats use,
and thus bigger fines.:S Roids are definitly the way to go....seem to be more acceptable in our modern times.....please people there is a wide divide between a man who has trained for 35+ years and has managed to hang onto a bunch of mates by having a win or 2 in a blue moon...... and a young gun who has come out firing with a real box of tricks..... bottom line both got fined.....and you the jury are open to draw conclusion on who had the most intent
