I think we're missing the point here a bit.
Yes, non-payment is a big issue, but allowing a horse onto a racetrack - nevermind letting it compete - without a passport is criminally negligent.
Passports are not simply there for identification purposes - they also carry inoculation information.
All very well checking the chip and ID'ing the horse with the NHA database - what if the horse had not been inoculated?
What if (worst case scenario) the horse had not been inoculated and was carrying AHS?
That would mean that every horse on that truck, on that race course and within a fairly large radius was immediately put at risk.
Sorry - you would not be allowed at a pony club event without a valid passport and proof of up to date vaccs. A lot of show organisers ask you to provide info on entry and again at the gate on arrival. If you don't have the info you are turned away. It's not to be mean, it's a simple house-keeping health and safety rule.
If the Pony Club know this, then I'm afraid the NHA / Stipes / course officials really have no excuse.

Craig, you are correct, however there is also a bold rule that states that a horse may not be nominated if the trainer does not have a passport. The owner/trainer was well aware from the first that they didn't have a pp so how can they even nominate?
We have got very strict about getting paid before picking up but this horse was originally booked to go to a trainer in Kmb that has credit with New Turf. Enroute the destination was changed and we were instructed to keep the pp as security.

The horse ran a month before so his Horse sickness vaccination was up to date. The Flu Vac was out of date. That could have been done in the interim and been shown to the stipes as a Vets certificate. I am not in posession of all the facts and just pointing out the reason it might have been allowed to race. This is not the 1st time a horse that has raced before has been allowed to race without a passport and wont be the last. As I said earlier, withholding a passport for any reason is not allowed by the NHRA. Trainers have had to get a judgement against the owner to get the NHRA to act and stop the owner racing until bills are paid. It is against the law for them to stop the horse racing unless it is proved that the money is owed( otherwise anyone could just say it out of spite and the story was not true and the horse gets scratched for no reason) and a judgement given against the owner. I think that is everything I was told.

This horse should be disqualified, IMHO. And if perchance the horse tests positive in the post race testing, the trainer will be able to use the excuse that they horse was not identified properly, and so the sample was not taken correctly! He WILL win that case on that technicality, and NOT be liable! This is a disgrace!

Yes Craig you are 100% correct. But once the horse gets off the truck we have nothing to hold onto except the passport.We where told on route that we had to charge the owner who does not pay and to find the horse is regesterd to another person.We have taken judgement against certain owners/trainers to get our money but the lawyers fees are getting steep now. You know whwn ever you book a horse with us that we ask who the owner is to see if they ok.

unless we name and shame these people who do not pay they will just use another trainer another transport company another bookie etc etc ...stop beating around the bush and mention NAMES
