Greg, I heard an interesting theory this morning early that Nel decided to put Botha in the box to get an idea what Roux knew and what the State did not know, but I think it backfired a little (if that was the case).

Haupie, if I may, do you think the amount of shots fired(4) will have a bearing? Surely there is intent if a self professed marksman fires more than one shot against an unknown assailant ?

Valid point made Mr H. Remember he is the only witness. If he says he was very afraid and thought 4 shots would do the trick, nobody can argue with him. HOWEVER he has made that affidavit and did not say much. He could be in trouble about that. Good one

Re: Re: Oscar Pistorius

I really didn't want to comment on this thread because the most important concern to me is that Reeva has lost her life... and that is a tragedy. The speculation about Oscar to me just says... stop speculating!!
I have one question though for Haupie because he seems to be the man in the know... are we really saying that there are two people in an apartment, one of those two people goes to turn the tv off for example and on their way back to the bedroom they hear a noise in the bathroom, assume for some bizarre reason that the person in the bathroom is not the other person known to be in the apartment but a 3rd party, panic and start blasting away with their gun and kill that person in the bathroom... but won't be found guilty of murder because they were in a state of panic? Because, they assumed, as we all do when we hear an unexpected noise in our house that there is no alternative but that it must be an intruder??? That is ok by South African law? I don't care if the shots were fired up, down, sideways or did a JFK ricochet, you don't fire a single shot until you identify who it is in the bathroom... surely??? Defence can rip Detective apart but, for me, it all hinges around the reason why Mr "X" assumed it was an intruder and why he did not make certain of their identify first before firing. Surely if you love someone you make sure they are safe first? I know that is what I do. And exactly how much of a threat is an intruder locked in a bathroom anyway?
When I was at the backpackers I asked a police officer what would happen if I shot an intruder and they answered... make sure you put a weapon on them after you've done it otherwise you can be "done" for murder. I don't think Reeva (rip) was armed.
And despite my words above, makes absolutely no sense to me any of this speculation, I plead again, let the law run its course and stop listening to "gossip".. so far it seems the public have been led a merry-dance with a shot in the bedroom, a bloodied cricket bat vital to the case etc etc etc.
