Hollywood Disappoint again
11 years 1 month ago
Cant believe whats happening here . Got a winning double bet that Hollywood paid into my account last night . This morning when logging in my account had been adjusted negatively . On calling them and querying this I was informed that Hollywood had made a mistake on their price that they had given me . They tell me that they are allowed to do this and thats detailed on the fine print once again . No call from them informing me abouit their incorrect price quoted to me etc .. I find this quite unacceptable . Just very dissappointed with Hollywood.

Sorry to digress, has their betting site gone down, I am battling to log in.
Guessing has never been widely acclaimed as a good gambling strategy.

I agree with you, they only adjust the bet after its declared a winner, why not rectify it before the bet occurs maybe you would've increased your stake etc

Price taken by punter is "advertised" price so they have to allow you the bet...eg. you go to the store and tag (advertised price) says R10 but actual price is R12,50 then the store has to allow you the price advertised of R10...I remember something along these lines from by Commercial Law studies but things could have changed since then...I stand corrected...law of contract requires offer (advertised price) and acceptance (you took the bet at the advertised price)...

Price available at any point in time is an advertised price so that is what is offered by the bookie and when I place a bet at that price, I have accepted the offer at that price...this is my limited understanding of the law of contracts...see link to Wendy Knowler article on subject:
www.iol.co.za/blogs/wendy-knowler-s-cons...1227976#.U2Ye4_mSyYI
Most interesting for me is following part:
"But the CPA does give retailers an “out” in terms of honouring prices which are obvious mistakes.
It states: “If a price as displayed contains an inadvertent and obvious error, the supplier is not bound by it, after correcting the error in the displayed price, and taking reasonable steps to inform consumers to whom the erroneous price may have been displayed of the error and the correct price.”
The issue is also dealt with under the law of contract.
One party must make a firm offer to another which may be accepted or rejected.
When an incorrect price is discovered, the store owner has the right to refuse to accept the offer of payment from a customer, so no contract is formed."
My emphasis...
But price was advertised and payment made when bet was taken so there was offer of price, there was acceptance of price and there was offer of payment and acceptance of payment at that price...so, my logic tells me, and I stand corrected, that there was a contract that is binding...
Maybe the legal fundis amongst the Clanners that add their weight of knowledge to this...
With respect to the second question, we would have agreed on a price for the job you did for me and, if I overpaid you, the contract (detailing work done and price) would show the error of my over-payment and be the grounds on which any recovery is done...

But who says it was a price advertised?
I see nae one has commented on the post where they are paying 7 times the tote payout on VC

Sorry Hibs..
TNaicker is correct in this instance.
An offer was made.... it was accepted .... payment was made... contract is hence concluded.
Whatever the "fine print" says is not according to contactual law.
Point to think about...
If Joe Soap walked into any branch of Hollywood took a bet as adverised (albeit wrongly priced). The bet comes in... the punter collects and walks out.
What recourse does Hollywood have now????
I have moved most of my online punting to Playabets. Although they have a online payout limit of 30k per multiple ticket, I am happy with that. It is protection for both parties.
